The details
- Eternal received two GST demand orders from West Bengal tax authorities totaling about INR 27.6 Cr.
- The orders were issued by the Additional Commissioner of State Tax (Appeals), West Bengal, under Section 73 of the CGST Act 2017 and West Bengal GST.
- The GST demand for FY21 is INR 9.85 Cr, and for FY22 it is INR 17.7 Cr.
- Eternal plans to challenge both orders based on legal and tax advisor advice.
- This is the third tax demand from West Bengal authorities in the same week; earlier on Jan 6, 2026, a INR 1.92 Cr order for FY20 was received.
- In 2024, Eternal received two West Bengal orders worth INR 27.55 Cr.
- In October 2025, Eternal got a GST demand of INR 128.4 Cr from UP authorities for FY23, its largest ever.
- Eternal faces tax disputes in UP, Delhi, Tamil Nadu, Maharashtra, and Karnataka.
The bigger picture
- Under the revised GST framework, delivery companies must pay 18% GST on delivery charges when the delivery partner is not GST-registered.
- GST on delivery fees affects roughly a quarter of Zomato's orders where delivery is not free.
- Eternal is also in controversy over gig worker pay and conditions; workers struck on Dec 25 and 31, 2025.
- Q2 FY26 consolidated net profit fell 63% YoY to INR 65 Cr, while operating revenue surged 183% YoY to INR 13,590 Cr.
