The bigger picture
- India's DPDP Rules 2025 (Rule 10) require verifiable parental consent before processing a minor's data.
- Malcolm Gomes, COO of IDfy, said the policy assumes consent without verification, which violates the DPDP.
- Under DPDP, a data fiduciary must verify the parent's identity via Aadhaar or DigiLocker token.
- Gomes noted that even Aadhaar or DigiLocker cannot confirm the verified adult is the child's parent or guardian.
- An unnamed lawyer said edtech gaming products need greater DPDPA scrutiny because they target minors.
