The details

  • The DPDP Rules will be rolled out in phases, with the Consent Manager framework effective 13 November 2026.
  • The full DPDP law will come into effect on 13 May 2027.
  • Penalties for failing reasonable security safeguards can be up to ₹250 crore.
  • Penalties for failing to report a data breach or mishandling children's data can be up to ₹200 crore each.
  • Other violations can attract penalties up to ₹50 crore.
  • An EY India survey (February 2026, 150+ professionals) found that 81% of organisations have not yet updated or drafted DPDP-compliant privacy policies or governance frameworks.
  • Only 48% of respondents have begun conducting gap assessments.

The bigger picture

  • Regulated sectors like fintech, banking, insurance, and telecom are further ahead in DPDP readiness.
  • Laggards include traditional industries such as manufacturing, offline retail, real estate, and mid-sized businesses.
  • The DPDP compliance services market is estimated at over ₹10,000 crore (~$1.2 billion) over the next three years.
  • Consent management alone accounts for roughly ₹1,000 crore of that market.
